General Terms and Conditions – Sprachschule Aktiv Regensburg
1. Registration for Courses – Start, Duration and Payment Terms
1.1 Registration for group courses, private lessons, company courses or telc exams can be made in writing, via the online registration form, or in person at the language school. Each registration constitutes a binding offer to enter into a contract. The contract between the customer and Sprachschule Aktiv Regensburg is concluded upon receipt of the course or exam confirmation.
1.2 The customer agrees to pay the course fees within 14 days of receiving the invoice or, if the course begins within this period, no later than the course start date. Payment can be made in cash, by bank transfer, or via other available online payment methods, which may incur additional processing fees. The customer is responsible for ensuring timely payment.
1.3 The obligation to pay for group, private, or company courses remains even if the participant fails to attend classes partially or entirely. Absence or non-attendance does not constitute withdrawal from the course and does not release the participant from the payment obligation.
1.4 Bookings are made for specific time periods rather than for language levels. Sprachschule Aktiv Regensburg does not guarantee the achievement of any particular proficiency level.
1.5 If a customer has been granted an installment plan and fails to make a scheduled payment within 10 days of its due date, the installment agreement becomes void, and the remaining total balance becomes immediately due.
1.6 All prices are quoted without German VAT. As an educational institution, Sprachschule Aktiv Regensburg is exempt from VAT.
2. General Conditions
2.1 Morning classes usually take place from 09:00 to 12:00. However, Sprachschule Aktiv reserves the right to adjust course times for organizational reasons. The latest possible start time for morning classes is 13:00. Adjustments to course times do not entitle the customer to terminate the contract or to claim a full or partial refund of the course fee.
2.2 No classes take place on public holidays. Lessons cancelled due to public holidays will not be rescheduled, and there is no right to a partial refund of the course fee.
2.3 One teaching unit corresponds to 45 minutes.Sprachschule Aktiv Regensburg primarily employs native-speaking teachers; however, customers have no entitlement to a specific teacher. The school reserves the right to change or replace teachers during a course. Such a change does not entitle the customer to cancel or withdraw from the course.
2.4 Sprachschule Aktiv Regensburg makes every effort to achieve the intended learning goals and to prepare participants for internal and external exams. However, the school accepts no liability for the achievement of any specific level or for exam results. 2.5 Sprachschule Aktiv Regensburg reserves the right to assign participants to a course level that corresponds to their actual language skills, even if a different level was originally booked. Placement is determined by a placement test. Such reassignment does not entitle the participant to cancel or withdraw from the course.
3. Right of Withdrawal for Distance Contracts, Cancellations, and Special Terms
3.1 If the customer is a consumer (that is, a natural person who concludes the order for a purpose that can predominantly not be attributed to their commercial or self-employed professional activity), they are entitled to a right of withdrawal in accordance with statutory provisions, provided that only means of distance communication were used for the contract negotiations and conclusion, unless the contract was not concluded as part of a distribution or service system organized for distance sales. Means of distance communication include all communication methods that can be used to initiate or conclude a contract without the contracting parties being physically present at the same time, such as letters, catalogues, telephone calls, faxes, emails, messages sent via mobile services (SMS), as well as broadcasting and digital services as defined in Section 1 (4) No. 1 of the German Digital Services Act.
However, no right of withdrawal exists for contracts concluded on-site at the premises of Sprachschule Aktiv.

The withdrawal must be communicated by means of a clear declaration (for example, a letter sent by post or an email) stating the decision to withdraw from the contract. The withdrawal period is 14 days, beginning on the day the contract was concluded. To meet the deadline, it is sufficient to send the withdrawal notice before the 14-day period expires. If the language course has already begun during the fourteen-day cancellation period, a cancellation is no longer possible. Further details regarding the right of withdrawal are set out in the separate Withdrawal Policy.
3.2 The booking of language courses is made for a predetermined period or, in the case of private or company courses, for a predetermined number of lessons. If the customer cannot attend the agreed lessons, they are not entitled to a replacement class or a partial refund of the course fee.
3.3 The customer also has the right to cancel the course within 24 hours after completing the first lesson (trial lesson = 45 minutes). A condition for this cancellation is that the customer attended the first lesson in full and in person. The cancellation must be submitted in writing or in text form (for example, by email) within 24 hours and does not require a statement of reasons. If the customer decides to continue the course after the trial lesson, that first lesson is considered part of the booked course package and is not free of charge.
3.4 For visa courses, cancellation after the trial session is not permitted.
3.5 In the case of a course package that extends over several months, the right of cancellation after the first lesson applies only once, at the beginning of the initial booking. For subsequent or extended bookings, a cancellation after the first lesson is no longer possible.
4. Special Conditions for Visa Courses
When booking language courses that are used for the purpose of obtaining a visa, the following terms apply:
4.1 At the time of registration, the customer is required to indicate that the booking is a visa course. A visa course is any course for which the course confirmation will be used to apply for a visa at an authority.
4.2 For bookings of a course with a duration of up to 3 months, the entire course fee is due in advance. For bookings of a course with a duration of more than 3 months, the customer must pay 50% of the total course fee in advance as a deposit. The remaining 50% is due at the start of the course. Customers may postpone the start date by up to 4 months in total. Any postponement must be communicated in writing before the original course start date.
4.3 If the visa is refused by the competent authority, the deposit will be refunded minus a processing fee of 250.00 EUR, provided that the school receives the official rejection letter from the authority no later than four months after the originally planned course start date. If the rejection letter is not submitted within this four-month period, no refund will be granted. A refund of the deposit is also excluded if a postponement of the course start requested by the customer was not communicated in writing before the original course start date, or if the course start has been postponed by the customer by more than four months in total. A refund is also excluded if the applicant withdraws their visa application.
Examples:
Refund (minus 250 € fee):
1. I informed the school in writing before the course start that I could not arrive on time
AND
2. I submitted the official rejection letter within 4 months after the originally planned course start date.
No refund:
1. I did not inform the school in writing before the course start that I could not come
OR
2. I did not submit the official rejection letter within 4 months after the originally planned course start date.
The Saturday online communication (grammar training) takes place only if the minimum number of participants is reached. If the Saturday session does not take place, there is no entitlement to a reduction or refund of the visa course price.
5. telc Exam Registration and Cancellation
Exam registrations are binding and non-refundable. Exam fees must be paid within 5 days of registration. The registration deadline is 15 working days before the exam date. An additional administration fee of 15 € applies. If the candidate is sick on the exam day, a medical certificate must be provided. In that case, a cancellation fee of 80 €
applies.
6. Private and Company Courses
6.1 For private and company courses, the exact lesson times can be arranged directly with the teacher or with the school. The booked package of hours must be planned and defined for at least one month from the time of booking. This includes agreeing in advance on when and where the lessons will take place, in coordination with the school or the teacher.
6.2 If the customer does not attend a scheduled lesson, there is no entitlement to a replacement lesson or a refund of any part of the course fee. After the statutory withdrawal period has expired, an already booked package of hours can no longer be cancelled. This also applies if the customer or the company later decides they no longer wish to use the remaining lessons. If the customer cannot attend an agreed lesson, they must inform the school or the teacher no later than 24 hours before the lesson starts, either in writing or by phone, in order to reschedule the appointment.
If the lesson is cancelled by the customer within the 24-hour window, there is no entitlement to a replacement lesson. For private and company courses, each booked appointment must always consist of at least two teaching units.
6.3 All booked hours in private or company courses must be used within one year from the date of booking. Any hours not used within one year expire. After this one-year period, no refund is possible and any unused hours can no longer be taken.
7. Special provisions in case of a low number of participants
Sprachschule Aktiv Regensburg reserves the right to postpone a course until the minimum number of three participants is reached or to cancel it. If fewer than four participants attend an intensive course, the daily lessons may be reduced to three teaching units (three times 45 minutes).
8. Liability Disclaimer
In cases of improper use of rooms, equipment, or internet access, the customer shall be liable for any resulting damages. The customer expressly releases Sprachschule Aktiv from any liability for damages caused by improper use of facilities, objects, or internet access. Participation in all courses and activities is at the participant’s own risk. Sprachschule Aktiv accepts no liability for accidents or other damages. Furthermore, the school assumes no responsibility for the loss of valuables, money, or personal belongings. This limitation of liability does not apply in cases of intent or gross negligence attributable to Sprachschule Aktiv. For damages caused by slight or simple negligence, the liability of Sprachschule Aktiv is limited to the type of foreseeable damage typical for this kind of contract and only insofar as an essential contractual obligation was breached. Sprachschule Aktiv accepts no liability for accidents or damages that occur on the way to or from the school premises. The customer indemnifies Sprachschule Aktiv from any claims made by third parties against the school arising from any legal or contractual breach committed by the customer in connection with course participation. The customer further indemnifies Sprachschule Aktiv from the costs of necessary legal defense, including all court and attorney fees. This does not affect any further claims for damages. Where the liability of Sprachschule Aktiv is excluded or limited, this also applies to the personal liability of employees, freelance staff, representatives, and other agents of the school.
